Terms

The terms of using Elje, in plain words. A draft awaiting lawyer review.

Awaiting lawyer review

Draft for lawyer review. This page is written in plain words so the lawyer has something to mark up. It is not yet the agreement, and nothing on it binds you or Elje until the reviewed version replaces it.

The operating entity's name and ABN will be added here when it is registered.

1. What Elje does

  • Prices fit-out goods landed to an Australian site, from factories in China.
  • Introduces you to factories and partners (forwarders, customs brokers, inspectors, installers) you choose.
  • Sells the Project Plan, Elje Assured and Managed Order, each described on its own page with its price.

2. What Elje does not do

  • Sell you goods. Your contract for the goods is with the factory.
  • Import the goods. You are the importer, and the goods are imported in your name.
  • Hold your money. Deposits go to the factory. With Assured, the balance goes to a licensed escrow partner under that partner's own terms.
  • Give a warranty on the goods. Elje Assured is a service: it books inspection, holds release of the balance to a passed inspection, and runs defect resolution through the factory and partners. It is not a product warranty from Elje.

3. Prices and estimates

  • A landed estimate is indicative. It is not a quote or an offer.
  • A Project Plan gives firm factory quotes and a dated landed price. Freight, exchange rates and government charges can move after that date.
  • Every quote shows what you pay Elje and what the factory pays Elje.

4. Fees

  • Samples $149, credited to the Project Plan. Project Plan $990. Elje Assured 2% of the factory order, minimum $600. Managed Order factory price plus 10%, Assured included.
  • Fees are paid to Elje and are separate from payments for the goods.
  • When a fee is refundable is set out on the page for that service.

5. Your rights under Australian law

Nothing in these terms takes away rights you have under the Australian Consumer Law. Where a service from Elje fails a consumer guarantee, you are entitled to the remedies the law gives you.

6. What you agree to

  • To give us accurate plans and information, and tell us when they change.
  • That a factory Elje introduced you to pays Elje a commission on your orders with it for 3 years, under its agreement with Elje. The factory pays it, and it is shown on your quote.
  • To use the site and our price data for your own project, and not to copy it in bulk.

7. Limits

The lawyer will set the limits of Elje's liability here, within what the Australian Consumer Law allows. Until then this section is a placeholder.

8. Privacy and introductions

How we handle your details is on the privacy page. What you agree to when we introduce you is on the consent page.

9. Disputes and law

Tell us first at hello@elje.au and a founder will answer. These terms are governed by the law of Queensland.
